Website Terms

Terms & Conditions

These Terms govern access to and use of the Mahalaxmi Tech Solutions website and explain how website enquiries, content and related interactions are handled.

Effective: 18 August 2026Governed by Indian law

Important

Website enquiry does not automatically create a software development contract.

Project scope, pricing, delivery, ownership and support are governed by the quotation, SOW, agreement or other project document accepted for that engagement.

Before you continue

The key points to understand.

01

Website use

These Terms govern use of our public website and related website interactions.

02

Project engagements

A website enquiry alone does not create a software development contract.

03

Project documents prevail

Accepted quotations, SOWs or signed agreements govern the specific project.

04

Your rights remain protected

Nothing in these Terms removes rights or remedies that applicable law does not permit us to exclude.

01

Acceptance & Scope

These Terms & Conditions (“Terms”) govern access to and use of the Mahalaxmi Tech Solutions website and related website interactions.

By accessing or using this website, you acknowledge these Terms. If you do not agree with them, you should discontinue use of the website.

These Terms apply only to the public website and general website interactions unless a separate written document expressly incorporates them.

These Terms do not, by themselves, create a software development, consulting, maintenance or other paid engagement.

02

About This Website

The website provides information about our software development capabilities, including web applications, mobile applications, custom software, SaaS products, business platforms, automation and related technology services.

You may browse this website for legitimate informational purposes.

If you enter into a binding transaction or project agreement with Mahalaxmi Tech Solutions, you must have the legal capacity and authority required under applicable law to do so.

If you communicate or enter into an agreement on behalf of a company, organisation or other entity, you represent that you are authorised to act on its behalf for the relevant purpose.

04

Acceptable Use

You may use this website only for lawful purposes and in a manner that does not interfere with its normal operation or the rights of others.

You must not knowingly:

  • Use the website for an unlawful, fraudulent or malicious purpose
  • Attempt unauthorised access to our website, servers, accounts, systems or infrastructure
  • Introduce malware, harmful code, automated attacks or other disruptive technology
  • Attempt to bypass security controls or interfere with website availability
  • Use our branding or content in a manner that falsely suggests our endorsement, partnership or affiliation
  • Use the website to violate intellectual property, privacy or other legal rights
05

Project Enquiries, Proposals & Quotations

Sending an enquiry, requesting a quotation, contacting us by email or discussing an idea does not automatically create a binding project engagement.

Any estimate, indicative price, timeline, preliminary discussion or website description may be subject to clarification, technical assessment and confirmation of the final project scope.

A quotation, proposal or statement of work may have its own validity period, payment terms, scope, assumptions and conditions.

A binding project engagement will be governed by the documents and acceptance process applicable to that particular engagement.

06

Project-Specific Agreements

Software projects may be governed by one or more separate documents, including an accepted quotation, proposal, statement of work, development agreement, service agreement, maintenance agreement or other written terms.

Those project-specific documents may cover matters including:

  • Scope and deliverables
  • Timelines and milestones
  • Pricing and payment schedules
  • Change requests
  • Acceptance and testing
  • Hosting and third-party services
  • Intellectual property rights
  • Confidentiality
  • Support and maintenance
  • Warranties and liability

If there is a conflict between these general Website Terms and a properly accepted project-specific agreement, the project-specific document will govern that project to the extent of the conflict.

07

Fees, Taxes & Third-Party Costs

This website does not set universal pricing for all software projects. Project pricing depends on the relevant scope, requirements and agreed commercial terms.

Fees, payment schedules, taxes and any applicable refund, cancellation or termination terms will be stated in the relevant quotation, invoice or project agreement.

Third-party services may involve separate charges, including services such as domain registration, hosting or VPS, cloud infrastructure, storage, SMS or OTP services, payment gateways, third-party APIs, app-store accounts or other external platforms.

Responsibility for such third-party charges will be determined by the applicable project documents.

08

Materials & Information Provided by You

If you provide us with text, images, logos, documents, software, datasets, credentials, specifications or other materials for a project or enquiry, you are responsible for ensuring that you are entitled to provide and authorise the relevant use of those materials.

You should not knowingly provide material that is unlawful, infringing, fraudulent or that violates another person’s intellectual property, privacy or other rights.

Project-specific obligations relating to client materials may be further defined in the applicable project agreement.

09

Website Intellectual Property

Unless otherwise stated, the website design, branding, text, graphics, code, visual elements and other original website materials are owned by or lawfully used by Mahalaxmi Tech Solutions and are protected under applicable intellectual property laws.

You may view the website for legitimate personal or business informational purposes.

You may not copy, reproduce, publish, distribute, commercially exploit, falsely attribute or create misleading derivative use of our protected website content without appropriate permission or another lawful basis.

10

Intellectual Property in Project Deliverables

These Website Terms do not automatically assign or transfer intellectual property rights in software, source code, designs, documentation or other project deliverables.

Ownership, licensing, assignment and permitted use of project deliverables will be governed by the applicable project agreement or other written document.

Project documents may also distinguish between custom deliverables and pre-existing materials, reusable components, frameworks, libraries, tools, third-party software, open-source software or background technology.

Any copyright assignment intended by the parties should be documented in writing in accordance with applicable law.

11

Third-Party Platforms & Services

Our website or projects may refer to or integrate third-party products, websites, APIs, cloud platforms, payment providers, communication providers or other external services.

Third-party services are operated independently and may be subject to their own terms, pricing, privacy policies, technical limits and availability.

Unless specifically agreed otherwise in writing, Mahalaxmi Tech Solutions does not control and cannot guarantee the continuous availability, pricing, policies or future functionality of independent third-party services.

12

Confidential Information

Ordinary website enquiries and general emails should not be treated as a secure channel for highly confidential information.

Please avoid sending trade secrets, passwords, private keys, payment credentials, production credentials or other highly sensitive information unless an appropriate secure method and, where required, a confidentiality arrangement have been established.

Formal confidentiality obligations for a project may be governed by a separate NDA or project agreement.

13

Website Availability & Security

We aim to maintain a reliable website, but we do not guarantee that it will always be uninterrupted, error-free or available at every location or time.

The website may be temporarily unavailable because of maintenance, upgrades, infrastructure issues, network failures, security events or matters outside our reasonable control.

We may modify, suspend or discontinue website features where reasonably necessary.

14

Project-specific liability, warranties and remedies are governed by the applicable project agreement rather than these general Website Terms.

Nothing in these Terms is intended to exclude or restrict liability, statutory rights, consumer remedies or other rights that cannot lawfully be excluded or restricted.

Electronic Communications & Contracting

You may communicate with us through electronic methods such as email.

Electronic communications may be used for proposals, quotations, acceptances and other project communications where appropriate and legally permitted.

The use of electronic communications does not mean that every email, website interaction or enquiry automatically forms a binding contract. Contract formation depends on the applicable facts, communications, accepted documents and requirements of law.

18

Changes to These Terms

We may update these Terms when our website, services, business practices or legal requirements change.

The latest version will be published on this page and may include an updated effective date.

Changes to these general Website Terms do not automatically alter a separately executed project agreement unless that agreement expressly provides otherwise.

19

Governing Law & Dispute Resolution

These Website Terms are governed by the laws of India.

If a concern arises regarding this website, we encourage you to contact us first so that the matter can be reviewed and, where possible, resolved directly.

Subject to any valid project-specific dispute resolution agreement and applicable mandatory law, disputes relating solely to these Website Terms will be subject to courts having competent jurisdiction under applicable law in Maharashtra, India.

Nothing in these Terms is intended to prevent a person from using a statutory forum, consumer remedy or other legal process that applicable law does not permit the parties to exclude.

20

General Provisions

If a provision of these Terms is found invalid or unenforceable, the remaining provisions are intended to continue to apply to the extent permitted by law.

A failure or delay by Mahalaxmi Tech Solutions to exercise a right in relation to these Website Terms does not automatically constitute a waiver of that right.

Headings are included for readability and do not independently change the meaning of a provision.

These Website Terms, together with our Privacy Policy, govern general use of this website. They do not replace a separate project-specific agreement.
